Terms of Use
Access to and use of this 'everysquaremile.co.uk' website is provided by the BBC subject to the following terms:
1. By using everysquaremile.co.uk you agree to be legally bound by these terms, which shall take effect immediately on your first use of everysquaremile.co.uk. If you do not agree to be legally bound by all of the following terms please do not access, contribute to and/or use everysquaremile.co.uk or any content located on the site.
2. The BBC may change these terms at any time by posting changes online. Please review these terms regularly to ensure you are aware of any changes made by the BBC. Your continued use of everysquaremile.co.uk or any content located on the site after changes are posted means you agree to be legally bound by these terms as updated and/or amended.
Use of everysquaremile.co.uk
3. You agree to use everysquaremile.co.uk only for lawful purposes, and in a way that does not infringe the rights of, restrict or inhibit anyone else's use and enjoyment of everysquaremile.co.uk. Prohibited behaviour includes harassing or causing distress or inconvenience to any person, transmitting obscene or offensive content or disrupting the everysquaremile.co.uk site.
Disclaimers and Limitation of Liability
4. everysquaremile.co.uk content, including the information, names, images, pictures, logos and icons regarding or relating to the BBC, its products and services or to third party products and services, is provided "AS IS" and on an "IS AVAILABLE" basis without any representations or any kind of warranty made (whether express or implied by law) to the extent permitted by law, including the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.
5. . Under no circumstances will the BBC and/or BBC Worldwide Limited be liable for any of the following losses or damage (whether such losses where foreseen, foreseeable, known or otherwise): (a) loss of data; (b) loss of revenue or anticipated profits; (c) loss of business; (d) loss of opportunity; (e) loss of goodwill or injury to reputation; (f) losses suffered by third parties; or (g) any indirect, consequential, special or exemplary damages arising from the use of everysquaremile.co.uk regardless of the form of action.
6. The BBC does not warrant that functions contained in everysquaremile.co.uk will be uninterrupted or error free, that defects will be corrected, or that everysquaremile.co.uk or the server that makes it available are free of viruses or bugs.
7. While the BBC expects all contributors to abide by these terms when submitting/sharing their content we cannot guarantee that this will always be the case or that the content will be accurate. The BBC therefore does not accept any responsibility for any content submitted to everysquaremile.co.uk by members of the public, partner organisations or any third parties. Any views expressed are those of the owners of the content and unless specifically stated are not those of the BBC. The BBC is also not responsible for content located on any external sites referenced on or linked to (whether using an embedded or text link) from everysquaremile.co.uk.
Intellectual Property
8. The names, images and logos identifying the BBC, BBC Worldwide Limited or any third parties and their products and services are subject to copyright, design rights and trade marks of the BBC, BBC Worldwide Limited and/or third parties. Nothing contained in these terms shall be construed as conferring by implication, estoppel or otherwise any licence or right to use any trademark, patent, design right or copyright of the BBC, BBC Worldwide Limited, or any other third party.
9.You may not copy, download, post, broadcast, make available to the public, adapt, modify or otherwise use everysquaremile.co.uk content in any way except as provided by the two licences below.
Contributions to everysquaremile.co.uk and ability to use everysquaremile.co.uk content
10. Please note that copyright in your contribution will remain with you and any permissions set out in the below licences to use or modify your content are non exclusive, so you can continue to use the material in any way including allowing others to use it.
11. When submitting content with everysquaremile.co.uk you must choose one of the following two licences which will set out how your content can be used by the BBC and other users of the site:
(i.) Limited Ability to Share/No Modifications
This licence can apply to any content submitted to everysquaremile.co.uk (eg any text, photographs, graphics, video or audio). Where you choose this licence your content will be marked with the logo.
By choosing this licence, you grant the BBC and users of everysquaremile.co.uk, free of charge, permission to copy, distribute and make publicly available your content in any media worldwide for personal, non-commercial use and/or for educational purposes only.
Any content marked with the logo (to the left) may not be adapted, altered or used to create a derivative work. Users of everysquaremile.co.uk may however make any technical modifications that are required to copy, distribute or make publicly available the content in other media and formats for their own personal, non-commercial and/or educational usages. The BBC may also modify your content on everysquaremile.co.uk for operational or editorial reasons
Any other use of content marked with the logo (to the left) requires the prior written permission of the copyright owner of the content.
(Additional terms which apply to both the Limited Ability to Share/No Modifications and Ability to Share/Modify licences are set out below.)
(ii.) Ability to Share/Modify
This licence can apply to any content submitted to everysquaremile.co.uk (eg any text, photographs, graphics, video or audio). Where you choose this licence your content will be marked with the logo (to the left). By choosing this licence, you grant the BBC and users of everysquaremile.co.uk, free of charge, permission to:
- copy, distribute and make publicly available your content in any media worldwide;
- modify or adapt your content on everysquaremile.co.uk; and
- create and reproduce adaptations and derivative works of your content in any other media worldwide. This includes the right to make any technical modifications that are required to copy, adapt and/or make publicly available the content in other media and formats.
Users of everysquaremile.co.uk may not copy, distribute, make publicly available or modify any content marked with the logo (to the left) for any commercial purposes.
Additional terms applying to both licences:
everysquaremile.co.uk users may copy, distribute, make publicly available and/or adapt content located on the site only under the terms of the relevant licence which include these additional terms.
Pages on other websites which displays content from everysquaremile.co.uk (whether in its original form or modified where permitted) must provide a link back to the original content on everysquaremile.co.uk. Any other non website use of everysquaremile.co.uk content must include suitable accreditation back to the everysquaremile.co.uk site. everysquaremile.co.uk users may not sublicense any of the content located on everysquaremile.co.uk or offer or impose any terms or technological measures on any of the content that restrict the terms of these licenses or the ability of the recipient of the content to exercise the rights granted to that recipient under the terms of these licenses.
everysquaremile.co.uk users must not distort, modify or take any other derogatory action in relation to any content which would be prejudicial to the original author's honour or reputation.
These licenses and the permissions granted under them will terminate automatically upon any breach by everysquaremile.co.uk users of the terms of these licenses or the terms of use. Any individuals or entities who have received copies or adaptations (where permitted) of content from an everysquaremile.co.uk user who has breached the terms of these licences, however, will not have their licenses terminated provided such individuals or entities remain in full compliance with the licences.
Please note that the above licences do not apply to any content (eg video, audio or images) embedded on everysquaremile.co.uk which is hosted on third party websites. Such content will usually have its own terms governing how it can be used. Please refer to the third party website where the content is hosted (usually indicated by the website's logo on the embedded player/content) to determine if and how you can use it.
12. By submitting your content to or sharing it with everysquaremile.co.uk, you:
- 12.1. warrant that your content:
- 12.1.1. is your own original work and that you have the right to make it available to the BBC and everysquaremile.co.uk users for all the purposes specified above (if you wish to contribute any text, images, video or audio content for which you do not own the copyright you must obtain the prior written consent of the copyright holder, and where you wish to embed content hosted on a third party website on everysquaremile.co.uk you must ensure that you have the rights to do so, for all the purposes specified above);
- 12.1.2. is not defamatory; and
- 12.1.3. does not infringe any law; and
- 12.1.4. that you have the consent of anyone who is identifiable in your content (before contributing any images or video in which children under the age of 16 appear, you must ensure you have the prior written consent of their parents or guardians), and
- 12.2. indemnify the BBC against all legal fees, damages and other expenses that may be incurred by the BBC as a result of your breach of the above warranty.
13. If you do not want to grant the permissions on the terms of either of the licences above, please do not submit your content to or share it with everysquaremile.co.uk.
14. The BBC may need to contact you for administrative or verification purposes in relation to your content, or in relation to particular projects, in accordance with the BBC's Privacy Policy.
everysquaremile.co.uk House Rules:
15. You agree to use everysquaremile.co.uk in accordance with the following house rules. If you find contributions to the site which you believe contravene these house rules, please notify us immediately so we can take the appropriate action.
Stick to the Seven Principles of everysquaremile.co.uk. We have seven simple principles for making the most of your contribution to the site. Please encourage others to apply these principles as well.
- Have a go. We believe everyone has something to contribute to everysquaremile.co.uk, even if it is simply to ask a question. Be bold and allow your curiosity to lead you.
- Be collaborative. Welcome constructive criticism and modifications of your contributions and encourage debate. Be helpful, generous and constructive when reviewing and modifying the contributions of others.
- Contribute for everyone. Your contribution will form part of a big, collaborative picture of your local area. Think about how to make your contribution interesting and enjoyable for other people.
- Be relevant. everysquaremile.co.uk is about the rich tapestry of events, places and people that have made your local area what it is. Consider whether your contribution will help capture an aspect of this bigger picture. Please do not contribute content that is not relevant to everysquaremile.co.uk.
- Verify where possible. Include references and sources for your contributions when you have them, so that they can be shared with others. Feel free to include your own original research.
- Be open minded. Your opinions may differ from those of other contributors. Be tolerant and seek consensus.
- Be patient. Users of all ages and abilities contribute to everysquaremile.co.uk.
Safety. Please do not reveal any personal information about yourself or anyone else (for example: telephone number, home address or email address) or any information that may compromise the security of your or someone else's property (for example, by stating that a house is empty all day, where the spare key is kept or that the downstairs windows are never locked). You may, however, include the publicly available details of organisations, such as the address of a library or museum.
Act responsibly. everysquaremile.co.uk is intended to be a pleasant and informative experience for all those who visit the site. For this reason, we have a list of 'don'ts' that we ask you to abide by. Contributions that breach the 'don'ts' will be removed and the appropriate action will be taken against those responsible. (For more information, see our Disciplinary Procedures below.)
- Don't submit contributions that are not civil and tasteful.
- Don't bully or intimidate other site users. Contributions must be constructive and polite, not mean-spirited or contributed with the intention of causing trouble.
- Don't make contributions of unlawful, harassing, defamatory, abusive, threatening, harmful, obscene, profane, sexually-oriented, racially-offensive, or otherwise objectionable material.
- Don't infringe anyone else's copyright or embed any content that (a) breaches these terms of use or (b) that you do not have the rights to embed.
- Don't use multiple logins. Please restrict yourself to a single login. If you lose your login details, please notify us for a reminder.
- Don't spam or flood the site.
- Don't use the site to advertise.
- Don't contribute images or video taken where photography or filming is prohibited.
- Don't use commercial music in any content submitted to or embedded on everysquaremile.co.uk.
- Don't contribute images or video in which children under the age of 16 appear, without the prior written consent of their parents or guardians.
- Don't impersonate other site users.
- Don't register inappropriate (e.g. vulgar, offensive etc) user names.
- Don't link out to websites carrying unlawful, harassing, defamatory, abusive, threatening, harmful, obscene, profane, sexually-oriented, racially-offensive, or otherwise objectionable material.
- Don't use the site to conduct personal disputes.
- Don't invade the privacy of others by revealing personal information such as contact details, addresses or postcodes.
- Don't abuse the complaints system.
- Don't contribute material with the intention of committing or promoting an illegal act.
Disciplinary procedure
16. In all instances, we will endeavour to treat transgressions on everysquaremile.co.uk in a fair and even-handed manner.
17. However, if you fail to abide by these terms of use and house rules, then the procedure outlined below will be followed in most cases.
First offence: You will receive an official warning from the site administrators.
Second offence: Your account will be suspended for two weeks.
Third offence: Your account will be closed permanently.
In each case the warning or suspension notice will be sent to the email address you have registered with everysquaremile.co.uk. The email will explain why you have received the notice/suspension and detail what action is being taken.
18. Re-registering during a period of suspension constitutes a third offence and all of your accounts will be closed permanently. If you post or submit offensive or inappropriate content to everysquaremile.co.uk or otherwise engage in any disruptive behaviour on everysquaremile.co.uk, and the BBC considers such behaviour to be serious and/or repeated, the BBC may use whatever information that is available to it about you to stop any further such infringements. This may include informing relevant third parties such as your employer, school or email provider about the infringement/s.
19. Please note that the everysquaremile.co.uk administrators reserve the right to delete any contribution at any time, for any reason, and are under no obligation to publish any work submitted. The BBC also reserves the right to take action against any account at any time for any reason, including closing your account immediately, permanently and without notice, at the discretion of the site administrators (for example, in the event of criminal or abusive behaviour).
General
20. This site is for those aged 16 and above.
21. If any of these terms are determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these terms are intended to be effective, then to the extent and within the jurisdiction in which that term is illegal, invalid or unenforceable, it shall be severed and deleted from these terms and the remaining terms shall survive, remain in full force and effect and continue to be binding and enforceable.
22. These terms shall be governed by and interpreted in accordance with the laws of England and Wales.
